Facts
Roemer (plaintiff) filed suit to challenge the constitutionality of a higher education grant program implemented by the Board of Public Works of Maryland (defendant). The grant program provided funding to religiously affiliated colleges and universities. Grant funding could be applied to any purpose, subject to the limitation that funds not be applied toward sectarian purposes. The federal district court upheld the constitutionality of the grant program. Roemer petitioned the United States Supreme Court for review.
