Facts
John Rogers (plaintiff) was injured when he slipped and fell in his hotel room at the MGM Grand Hotel (MGM) (defendant) as a result of water that had accumulated on the tile floor. When John’s wife, Bernadette Rogers, contacted MGM’s Risk Management department to complain, risk-management representative Corrine Toscano offered to comp the Rogerses’ hotel room and give the Rogerses a restaurant credit if John signed a release. Bernadette agreed, and Toscano brought the release to the Rogerses’ hotel room. Bernadette signed the release, but John did not. John claimed that he did not speak to Toscano but saw his wife sign the release. Toscano claimed that she explained the release to both John and Bernadette and that John made a shrugging gesture that indicated Bernadette would sign on his behalf. John brought a negligence action against MGM for his injuries. MGM argued that the release barred recovery as a valid accord and satisfaction..
