Facts
Rohm & Haas Company (R&H) (plaintiff) brought a patent-infringement action against Crystal Chemical Company (Crystal) (plaintiff). The federal district court found in favor of R&H. On appeal, the United States Court of Appeals for the Federal Circuit reversed, holding that the patent was invalid on the ground of fraud perpetrated by R&H during the patent-application process. Crystal then filed for attorney fees and expenses, specifically as incurred on the appeal.
