Facts
Harley and Pauline Rolfe (plaintiffs) owned the Western Motel and other properties. The Rolfes wanted to develop the Western Motel into a resort complex. The Rolfes entered into an agreement with John Varley (defendant) to help with the development. Under the agreement, Varley agreed to pay all debts and obligations encumbering the Western Motel. Using Varley’s money, the parties pursued development of the property. Varley paid for two years, but the development plan ultimately fell apart. Varley sued, and the court granted Varley an equitable lien on the Rolfes’ property in the amount of the money Varley expended and interest. The Rolfes appealed.
