Ross University School of Medicine, Ltd. (Ross) (plaintiff) sued Brooklyn-Queens Health Care, Inc. (Brooklyn-Queens) (defendant) for breach of contract, seeking specific performance as well as consequential and incidental damages. Ross subsequently moved for summary judgment, seeking more than $20 million in damages. An award of $20 million would put Ross in the position it would have occupied if Brooklyn-Queens had not breached the parties’ contract. Brooklyn-Queens responded with a motion for summary judgment seeking dismissal of Ross’s request for specific performance. The court considered Brooklyn-Queens’s motion.
