Facts
Cabot Oil & Gas Corporation (Cabot) (defendant) and its subsidiary GasSearch Drilling Corporation (GasSearch) (defendant) conducted drilling operations near the home of a married couple, Frederick and Debra Roth (plaintiffs). A Cabot representative obtained permission from the Roths to extract natural gas from their property through a process of hydraulic fracturing (also known as fracking). The process involved the underground injection of chemical fluids. The Roths received assurances that their quality of life and enjoyment of their property would not be adversely affected. However, the Roths found that their groundwater supply became brown, cloudy, and malodorous. Meanwhile, the Pennsylvania Department of Environmental Protection (DEP) cited Cabot and GasSearch for noncompliance with various state environmental regulations. The DEP also found dangerous levels of methane in the Roths’ groundwater supply. The Roths brought suit against Cabot and GasSearch in federal district court. The Roths’ claims included common-law negligence and private nuisance, both of which Cabot and GasSearch moved to dismiss.
