Royal Swan Navigation Co. v. Global Container Lines, LTD.
United States District Court for the Southern District of New York
868 F. Supp. 599 (1994)

- Written by Alex Ruskell, JD
Facts
Royal Swan Navigation Co. (Royal) (plaintiff) filed suit against Global Container Lines, Ltd. (Global) (defendant) and sought an attachment under Federal Rule of Civil Procedure Rule B(1), which stated, “With respect to any admiralty or maritime claim in personam a verified complaint may contain a prayer for process to attach the defendant’s goods and chattels . . . if the defendant cannot be found within the district.” The court granted the attachment, and the warrant of attachment was served on Global’s bank account. Global responded that the attachment should be vacated because Global could be found within the district. Specifically, Global argued that it used lawyers as agents in the district and that one of its directors traveled to the district almost every week.
