Facts
Catholic Medical Center (CMC) (defendant) sold and surgically implanted a prosthetic knee in Royer (plaintiff). The prosthetic knee had to be removed, and a new one surgically implanted, after it was discovered that the original prosthesis was defective. Royer sued, claiming that CMC was strictly liable because it had sold him a prosthesis with an unreasonably dangerous design defect. The trial court dismissed CMC, finding that it was not a seller of goods for strict products liability purposes. Royer appealed.
