Facts
Mrs. Ruffin (plaintiff) filed for divorce on August 19, 1996. On September 19, 1996, Mr. Ruffin (defendant) was ordered to pay $120 per week in child support and $80 per week in spousal support. This was a pendente lite order entered to establish support while the divorce litigation was pending. The order required that the support payments begin on September 20, 1996. On September 28, 1996, Mr. Ruffin won $4.9 million from a $2 lottery ticket. Mr. Ruffin had not paid any support payments. Mrs. Ruffin moved the trial court to impose a constructive trust on the lottery winnings because the money spent on the lottery ticket should have been paid as part of the court-ordered support payments. The trial court denied the requested relief, and Mrs. Ruffin appealed to the Virginia Court of Appeals.
