Facts
Edward Salvatore Rusk (defendant) met the victim at a bar where they had a short conversation. As the victim was about to leave, Rusk asked for a ride home. The victim agreed. When they arrived at his apartment, the victim parked but did not turn off the ignition. Rusk asked her to come inside but she refused. He removed her keys from the ignition and asked her to come in again. The victim later testified that she went inside with him because she was scared and did not know what else to do. In Rusk’s room, he began to undress her. When she began crying, Rusk lightly choked her. She later testified that she was scared and complied because of the look in his eyes. They then proceeded to have sexual intercourse.
