Facts
Rachele Russ (plaintiff) applied for Social Security disability benefits, claiming that her obesity prevented her from engaging in substantial gainful activity. Russ’s applications were denied initially, upon reconsideration, and following an administrative-law judge (ALJ) hearing in which the ALJ concluded that, although Russ’s impairment was disabling, she was not entitled to benefits because she failed to follow prescribed treatment. This decision was based on Russ’s treating physician’s response to interrogatories that he had urged Russ to continue to lose weight to improve her condition. The ALJ’s decision became the final decision of the Commissioner of the Social Security Administration, Jo Anne Barnhart (defendant). Russ sought judicial review of the commissioner’s denial in a United States district court.
