Facts
Sharif Haji-Ali (defendant) caused a car accident, injuring Sheelagh Russell (plaintiff). Russell sued Haji-Ali for negligence. Russell’s damages exceeded Haji-Ali’s $50,000 insurance policy, but Russell had underinsured-motorist coverage through her insurance company. Prior to trial, Russell’s insurer paid her $50,000 in exchange for the release of her underinsured-motorist claim. Russell’s insurer did not obtain subrogation rights. A jury subsequently awarded Russell $102,974 in damages. Haji-Ali moved to reduce damages by Russell’s insurer’s $50,000 payment. The trial court denied the motion, and Haji-Ali appealed.
