Facts
A chauffeur (defendant) was driving a store manager (plaintiff) on company business when the chauffer rear-ended another car on a Connecticut road, injuring the manager. The chauffer and the manager, both of whom were Massachusetts residents, worked in Massachusetts for the same Massachusetts corporation. At the time of the collision, the two were traveling through Connecticut with no intention of stopping in the state. In addition to collecting workers’ compensation, the manager sued the chauffer for damages in Massachusetts state court. After a jury returned a verdict for the manager, the trial court granted the chauffer’s motion for a judgment notwithstanding the verdict. The manager appealed.
