Facts
After Virginia Salaiscooper (defendant) was arrested for solicitation of prostitution, she petitioned the Nevada Supreme Court, arguing that the district attorney’s policy of prohibiting his deputies from entering into plea negotiations with female defendants charged with solicitation of prostitution was impermissible unconstitutional selective prosecution and violated the Equal Protection Clause to the U.S. Constitution. Salaiscooper claimed that the district attorney’s policy thus prevented female defendants from being able to attend a diversion class in order to avoid solicitation convictions. The Nevada Supreme Court reviewed Salaiscooper’s petition.
