Facts
The Soviet government confiscated all oil lands located in Russia and sold all the oil extracted from these lands to Standard Oil (defendant). Salimoff & Co. (Salimoff) (plaintiff), a former owner of the property and a Russian national, brought an equitable action in United States courts seeking to establish that the Soviet government was an unrecognized government, and thus that its confiscatory decrees were not valid and enforceable. The lower courts dismissed the case, and Salimoff appealed.
