Facts
Paula Amoroso (plaintiff) stayed at the Diplomat Hotel (Diplomat) (defendant). Sunrise Water Sports, Inc. (Sunrise) rented part of Diplomat’s property to operate a sailboat rental stand. Diplomat placed a brochure in each hotel room that alerted guests to the availability of sailing at the hotel. When guests rented a sailboat from Sunrise, they paid via a charge to their room at the Diplomat and left their room key as collateral. Amoroso rented a sailboat from the Sunrise stand and was injured when a piece of the boat broke. Amoroso brought a products-liability suit based on strict liability against Diplomat. The trial court directed a verdict for Diplomat. The court of appeal reversed and certified to the Supreme Court of Florida the question of whether the doctrine of strict liability as to defective products extends to commercial lease transactions of those products.
