Facts
The San Antonio Conservation Society (plaintiff) filed an action seeking to stop the approval and funding of a highway project by the secretary of the United States Department of Transportation (USDOT) and the Texas Highway Department (THD) (defendants) that would have cut through a San Antonio public park. The district court held that funding and construction of two segments of highway on either end of the park could proceed. The San Antonio Conservation Society submitted a petition to the United States Supreme Court.
