- Written by Corey Farris, JD
Facts
Guadalupe Sanchez (defendant) was charged with the rape and confinement of a 17-year-old girl. At trial, the trial court gave a jury instruction that prevented the jury from considering voluntary-intoxication evidence when determining Sanchez’s mental state. Sanchez was convicted and sentenced. Sanchez appealed, arguing that the jury instruction was in error. The court of appeals affirmed, and Sanchez appealed again.
