Facts
A woman obtained prescription medication from multiple pharmacies and, subsequently, allegedly caused an automobile accident. As a result of the accident, one person died and another person suffered severe injuries (plaintiffs). The plaintiffs then filed a lawsuit against the pharmacies, including Wal-Mart Stores, Inc. (defendant), alleging wrongful death and a personal-injury claim. The plaintiffs alleged that Wal-Mart violated the statutes governing pharmacies by filling the prescription with the knowledge of the pharmacy customer’s prescription-filling activities. Wal-Mart and the other pharmacies filed a motion to dismiss the complaint, which the trial court granted. The plaintiffs appealed.
