Facts
In 1978, Robert Knapp (defendant) contacted a broker to put his condominium up for sale. Ronald Sanders (plaintiff) made an offer for the property, which was accepted. When Knapp was informed of this, he discovered that his estranged wife was a joint tenant with him in the ownership of the condominium. When his wife refused to consent to the condominium’s sale, Sanders brought suit against Knapp.
