Facts
Four-year old Ramero Sandoval (plaintiff) rode his tricycle from his front yard into the street and was struck by an oncoming car. Ordinarily, the gate to the fenced yard was closed, preventing Ramero from leaving the front yard. However, Ramero’s father, Antonio, forgot to latch the gate closed when he left before the incident occurred. Ramero, through a guardian ad litem, filed a negligence suit against his parents, Antonio and Angelita (defendants). The trial court granted the parents’ motion for summary judgment based upon the doctrine of parental immunity. Ramero appealed.
