Facts
The Help America Vote Act (HAVA) authorized provisional ballot casting. Under HAVA, provisional ballots counted only if cast in the proper jurisdiction. The meaning of jurisdiction in HAVA was ambiguous. Ohio regulation required immediate verification of a voter’s residence before allowing provisional ballot-casting. The district court concluded that jurisdiction referred to county. This decision would have validated ballot-casting outside the precinct of the voter’s registration.
