Facts
Tina Sargent’s daughter Anna died after falling from a steep outdoor stairway at a residential building owned by Fabiola Ross. Sargent (plaintiff), as administratrix, sued the landlord, Ross (defendant), for negligent construction and maintenance of the stairway. The jury returned a verdict in Sargent’s favor. The trial court denied Ross’s motion for judgment notwithstanding the verdict, and Ross appealed.
