Facts
Spot Pack, Inc. (Spot) (plaintiff) sued its insurer, Saskatchewan Government Insurance Office (Saskatchewan) (defendant) after Spot’s vessel was destroyed by fire. Saskatchewan had rejected Spot’s claim. Saskatchewan stated that the insurance contract required Spot to keep its vessel seaworthy and that Spot had breached this promise when its crew failed to install a circuit breaker that might have prevented the fire. Spot sued, and the court ruled in favor of Spot. Saskatchewan appealed, arguing that Spot had breached a continuing promise to keep the vessel seaworthy.
