Facts
Savage (plaintiff) was employed by the accounting firm Price-Waterhouse in Pittsburgh. He interviewed for and was offered a position with one of the firm’s clients, Spur Distributing Company (defendant) in Nashville. Savage asked the Spur Distributing vice president and secretary whether the position would be temporary or permanent. They informed Savage the position was permanent so long as the company was satisfied with his performance. Savage accepted and relocated to Nashville. He was terminated a little over a year later. The reasoning offered was a reorganization of duties in the secretary’s office. Some evidence suggested the termination was due to a disagreement with a new employee. Savage brought an action against Spur Distributing for breach of an employment contract. The trial court directed a verdict for Spur Distributing and dismissed the claim. Savage appealed to the Tennessee Court of Appeals.
