Facts
Proposition 121, the Open Elections/Open Government Act, was a proposed amendment to replace Article 7, § 10 of the Arizona Constitution by ballot initiative. If enacted, proposition 121 would have replaced Arizona’s direct-primary election law authorizing partisan-primary elections with an open, top-two primary election. In a top-two primary, the two candidates receiving the most primary votes appear on the general-election ballot regardless of the candidates’ party affiliation. Proposition 121 would also eliminate public funding for political-party endorsements, partisan candidate support, and party officers’ elections. Save Our Vote, a political committee, and others opposing the proposition (the opponents) (plaintiff) filed a lawsuit alleging proposition 121 violated the Arizona Constitution’s separate-amendment rule.
