Facts
Dale Savoie was employed by Lafourche Boat Rentals, Inc. (Lafourche) (plaintiff) to captain one of its vessels. Loffland Brothers Company (Loffland) (defendant) engaged Lafourche to transport certain items to a Loffland barge. A metal beam extended across one of the stairways on the Loffland barge such that a tall man using the stairs would need to duck to avoid hitting his head. Savoie was tall enough for this to be an issue, and he ducked under the beam when using the stairway. One morning, Savoie forgot to duck and injured himself. Savoie recovered maintenance and cure benefits from Lafourche, his employer. Lafourche then filed a third-party complaint against Loffland for reimbursement of those payments. The district court awarded Lafourche reimbursement, and Loffland appealed.
