Sawada v. Endo
Supreme Court of Hawaii
561 P.2d 1291 (1977)
- Written by Sean Carroll, JD
Facts
The Sawadas (plaintiffs) were injured in a car accident with Kokichi Endo (defendant). When the accident occurred, Endo was the owner of land as a tenant by the entirety with his wife. Before the trial on the accident was held, the Endos deeded their land to their sons. Subsequently, the Sawadas were each awarded a monetary judgment against Endo for his role in the accident. In trying to obtain satisfaction from the judgment, the Sawadas brought suit seeking to set aside the Endos’ transfer of land to their sons. The trial court ruled against the Sawadas, and the Sawadas appealed.
