Facts
In 1911, there were three banks in the city of Abilene. That year, the state charter board received applications to form two more banks, Commercial State Bank and Central State Bank, in Abilene. Commercial State Bank’s application was granted, but Central State Bank’s was denied. The state charter board denied the Central State Bank’s application after concluding that the local economy of Abilene could not support a fifth bank in the city. The incorporators of Central State Bank (plaintiffs) sued the state charter board, arguing that the denial of their application violated their constitutional rights.
