Schold v. Sawyer
Schold v. Sawyer
Colorado Court of Appeals
- Written by Sean Carroll, JD
Facts
Njal and Jane Schold (plaintiffs) owned an express, 40-foot-wide right-of-way easement over the property of William and Mary Sawyer (defendants). The Scholds used the easement as a driveway to access their property. The Sawyers constructed gates and cattle guards on either side of the driveway. The Scholds brought suit seeking an injunction and the removal of the gates as interfering with their easement. The trial court granted summary judgment to the Scholds. The Sawyers appealed.
