Schonberger v. Roberts
Iowa Supreme Court
456 N.W.2d 201 (1990)
- Written by Abby Roughton, JD
Facts
Rodney Schonberger (plaintiff) was injured during his employment when his car was struck by a truck owned by Buck Hummer Trucking (Buck) (defendant) and being driven by Carroll John Roberts (defendant). Schonberger suffered injuries and was unable to work for a short time. Schonberger received workers’-compensation benefits including reimbursement for medical bills and payment for future medical expenses. Schonberger subsequently brought a negligence action against Buck and Roberts to recover for his injuries. At trial, Buck and Roberts tried to introduce evidence about the medical expenses and workers’-compensation benefits paid to Schonberger. However, the trial court refused to admit the evidence. The jury ultimately found for Schonberger and awarded damages. Buck and Roberts appealed to the Iowa Supreme Court, challenging the trial court’s refusal to admit the evidence regarding the payments to Schonberger.
