Facts
Michael Schrack (defendant) pretended to be a family friend of 90-year-old Herman Bode. Bode allowed Schrack into his home to discuss supposed plans for a cookout. Schrack struck Bode and demanded money. Schrack also searched Bode’s home for valuables and later cut Bode’s hand. Bode managed to escape, and a neighbor called the police. Schrack was arrested, tried before a jury, and found guilty on multiple counts, including burglary. Schrack appealed, arguing that he entered Bode’s home with Bode’s consent. The Florida District Court of Appeal granted certiorari.
