Facts
Robert and Ann Pritts (plaintiffs) owned a tract of land in an area zoned for residential use. The zoning ordinance also designated certain uses as special-exception uses. One such special-exception use was the operation of a funeral home. The Prittses applied for a special-exception use to operate a funeral home. Roger Schultz and others (defendants) opposed the application. The Carroll County Board of Zoning Appeals (the board) denied the application. The Prittses brought suit appealing the denial. The trial court did not consider the adverse effects of the proposed use but reversed the board’s decision on other grounds. Schultz and the others appealed.
