Facts
Xerox Corporation's (Xerox) (defendant) patents for its copying machines gave it substantial market power in the copying market. SCM Corporation (SCM) (plaintiff) asked Xerox to grant it licenses to use its patents. Xerox refused. SCM sued, alleging a violation of the Sherman Act. The jury awarded SCM treble damages of $111.3 million. The district court set aside the verdict. SCM appealed.
