Facts
Erin and Laura Scofield (plaintiffs) were traveling with their mother in Mexico when they were injured in a car accident. Their mother was killed in the accident, and their father arranged for Air Evac to transport them back to the United States. Critical Air Medicine (Critical Air) (defendant) sent its own plane to where the Scofield girls were going to be picked up by Air Evac. Critical Air then transported the girls back to the United States; however, the girls did not know they were traveling in a plane not authorized by their father. If the girls had known the Critical Air plane was not the transportation authorized by their father, they would not have boarded the plane. The girls’ father brought suit against Critical Air for false imprisonment. The jury found Critical Air liable for false imprisonment and awarded damages to the girls. Critical Air appealed the jury’s decision.
