Facts
Wilmer and Grace Scott entered a separation agreement and divorced. The divorce decree incorporated the separation agreement’s terms, including provisions for property distribution, spousal support, and child support. Wilmer separately assigned to his and Grace’s daughter, Virginia, his one-half interest in his father’s estate for consideration of $1. The decree did not incorporate this assignment. Wilmer’s father died, leaving an estate worth $490,000. The estate’s administrator, the First National Bank of Baltimore, filed an interpleader action to determine whether the funds should be distributed to Virginia (plaintiff) or Wilmer (defendant). The trial court found for Virginia. Wilmer appealed.
