Facts
Moragues Lumber Co. (Moragues) (plaintiff) wished to charter a ship that Scott (defendant) planned to purchase to transport lumber. Scott purchased the ship, and Moragues was ready, willing, and able to charter the ship. However, Scott, without notifying Moragues that it had purchased and received the ship chartered it to a third party. Scott appealed judgment for Moragues.
