Facts
The Securities and Exchange Commission (SEC) (plaintiff) instituted a civil-enforcement action against Henry Nicholas and William Ruehle (defendants), among others. Nicholas and Ruehle also faced criminal charges related to the same conduct that was the basis for the civil-enforcement action. The United States Attorney’s Office (USAO) sought to intervene in the civil-enforcement action. The USAO moved for an order to stay discovery and other proceedings so that Nicholas and Ruehle could not use civil discovery to benefit their criminal case.
