Facts
Mickey Segal and Size It, LLC (plaintiffs) sued ASICS America Corporation (ASICS) and others (collectively, ASICS) (defendants) for fraud. After the jury found in ASICS’s favor, ASICS filed a memorandum of costs. Segal and Size It moved to tax costs, meaning that they asked the court to deny, or at least reduce, some of ASICS’s claimed costs. Specifically, Segal and Size It challenged ASICS’s ability to recover costs for exhibits and demonstratives that were prepared but not ultimately used at trial. The trial court declined to reduce ASICS’s costs. The court of appeal affirmed. The California Supreme Court granted review.
