Facts
Daniel Shaffer (plaintiff) ordered a glass of wine at a restaurant operated by Victoria Station, Inc. (Victoria Station) (defendant). The glass broke, injuring Shaffer. Shaffer sued Victoria Station for negligence, breach of implied warranty under the Uniform Commercial Code (UCC), and strict liability under the Restatement (Second) of Torts. Shaffer voluntarily dismissed the negligence claim. The trial court found that Shaffer's claims sounded in negligence only, and granted Victoria Station's motion to dismiss Shaffer’s remaining claims. The Court of Appeals affirmed. Shaffer appealed.
