Facts
The residents of Alappuzha, a district of Kerala, did not have access to safe drinking water, a problem that had been ongoing for decades. In 2000, the Kerala Water Authority (the authority) (defendant) devised the Alappuzha Water Supply Scheme (the scheme) to provide clean drinking water. The authority conducted studies for two years before considering several potential sites for establishing a well. At one of the potential sites, the authority placed a foundation stone inscribed with the names of relevant political leaders. No further progress on the wells was made. Two residents, including Shajimon Joseph (plaintiff), filed a writ petition. Joseph asked the court to require the production of all information relating to the scheme and to require the authority to complete the scheme. The authority argued that it was unable to complete the project because the government refused to guarantee a loan. The State of Kerala (defendant) did not respond to the writ petition.
