Facts
Richard Sheffer (plaintiff) sued Sears & Roebuck, Inc. for violations of the Fair Credit Reporting Act (FCRA) and sought damages of $300,000. Shefer prevailed after a jury trial, but was only awarded $1,000 in actual damages. The jury also did not award Sheffer any punitive damages. Sheffer subsequently filed a motion for attorney’s fees and costs pursuant to the cost-shifting provision of the FCRA, 15 U.S.C. § 1681o(a)(2). Sheffer sought fees for hours the lead attorney preparing for trial and doing clerical work.
