Facts
Greenpeace Inc. (defendant) launched protests against Shell Offshore Inc. (plaintiff) for oil drilling and exploration in the Artic Ocean near Alaska. Shell received a preliminary injunction barring Greenpeace from protesting Shell’s activities and also made a claim for damages relating to Greenpeace’s protests. The injunction levied fines against Greenpeace if it continued to protest but levied no fines if Greenpeace stopped. Greenpeace appealed the injunction. While the appeal was pending, the preliminary injunction expired and Shell announced that it would cease exploration in offshore Alaska for the foreseeable future.
