Facts
The New Jersey legislature enacted a statute regulating the award of bachelor’s degrees by institutions of higher education and delegating the authority to the State Board of Education (State Board) (defendant) to prescribe and enforce regulations, establish standards, and license institutions of higher education within the state. Shelton College (plaintiff) filed a lawsuit challenging the New Jersey statute, arguing that the state did not have the authority to regulate the award of bachelor’s degrees and that the statute did not specify sufficient standards for the State Board to follow in violation of the federal and state constitutions.
