Facts
Ice and snow fell from the roof of a building with several owners (defendants), hitting and injuring Shipley (plaintiff) while she was walking down the sidewalk. The building’s construction made it inevitable that snow and ice would accumulate on the roof and ultimately fall. However, the building owners argued that users of the sidewalk assumed a risk of possible injury. Shipley was awarded damages. The building owners appealed. The Massachusetts Supreme Judicial Court granted certiorari.
