Facts
Shirley McCarthy was a citizen of the United Kingdom (UK) and of Ireland but had lived her whole life in the UK. McCarthy married a citizen of Jamaica (McCarthy’s husband), and the two applied to UK authorities for a residence permit for McCarthy’s husband under European Union (EU) law. The UK authorities denied the application, and McCarthy sued. The highest court in the UK requested a preliminary ruling from the European Union Court of Justice.
