Facts
The defendant ad-libbed a remark about the plaintiff on a national radio broadcast, saying “I wish I had as much money as [the plaintiff] owes . . . [to] everybody—oh, a lot of people.” The plaintiff brought a defamation suit. The defendant moved to dismiss the suit on the grounds that the statement was not libel because it was not reduced to writing.
