Facts
Eric Davis, Natasha Shumate, and their child Naera (plaintiffs), who are all African American, tried to book a room at the Clarion Hotel (Clarion). However, the clerk, Lisa Pierce (defendant), told Davis that no rooms were available. Davis and his family alleged that Pierce refused to rent them a room and lied about the unavailability of rooms because of the color of Davis’s skin. Pierce said she didn’t have to explain anything to Davis and told him to get out of her hotel. Davis asked Pierce if she told him no rooms were available because he was black. Pierce replied, “Yes.” Davis and his family claimed that three white men were provided a room without hesitation. Natasha, Naera, and others in the lobby “witnessed, heard, and experienced” the exchange between Davis and Pierce. Twin Tier Hospitality, LLC (Twin Tier) (defendant) and Pierce filed a motion to dismiss the Davis family’s claims for intentional infliction of emotional distress (IIED).
