Facts
Paul Siegell (plaintiff) was participating in a frisbee relay race during a physical-education class at school. While Siegell and another student both were pursuing the same frisbee, the other student pushed Siegell from behind. Siegell suffered injuries, and he and his mother sued the Herricks Union Free School District (district) (defendant), alleging that the school’s negligent supervision proximately caused Siegell’s injuries. The trial court dismissed the district’s motion for summary judgment, and the district appealed.
