Facts
Martin Luther King Jr. Park in Buffalo, New York, was listed on the National Register of Historic Places. In 1983, the city board of education (defendant) proposed a portion of the park next to the Buffalo Museum of Science as the site for a new public school. The state department of education approved the proposed site. The Sierra Club (plaintiff) commenced an Article 78 proceeding to annul the approval of the site, asserting that there was no statutory authority for the alienation of park lands. The proceeding was dismissed, and the Sierra Club appealed.
